Mr. Caraccio has been doing 601A Provisional Waivers since their inception in 2013. He has handled nearly 100 601A Waiver cases since that time and has had tremendous success obtaining these waivers for his clients.

Having done so many of these waivers of the course of many years he has developed strategies and methods for these waivers case and he has enhanced these strategies and methods over the years in order to maximize approvals and avoid Requests for Evidence from USCIS, which can delay the case.

The 601A Provisional Waiver allows a foreign national who is inadmissible to the US for certain reasons to obtain a waiver or a pardon to cure their inadmissibility while they are still in the US. Prior to the Provisional Waiver, the foreign national would have to apply for a waiver after they left the US and they would have to wait years abroad, separated from their family before they got a response.

The 601A Provisional Waiver is available to foreign nationals who are otherwise admissible but:

  • Entered the US illegally and accrued unlawful presence;

  • Entered on a K Fiance Visa and did not marry; and

  • Entered the US as a crewman and overstayed.

Mr. Caraccio has applied many of the strategies and methods from Provisional Waivers towards other similar waivers. Specifically, Mr. Caraccio has used what he learned from doing 601A  Provisional Waivers to increase the success rates on standard 601 Waivers of inadmissibility.

The Law Office of Joseph Caraccio  handles all forms of Visa Waivers including waivers inadmissibility based on:

  • Unlawful Presence (INA section 212(a)(9)(B));

  • Fraud or Misrepresentation (INA section 212(a)(6)(c));

  • Criminal Conviction (INA section 212(a)(2));

  • Health-Related Grounds (INA section 212(a)(1));

  • Alien Smuggling (INA section 212(a)(6)(E));

  • Subject to Civil Penalty (INA section 212(a)(6)(F)).
